Court slams N10m damages on pastor for trespass

A Benin High court has slammed N10 million damages on a pastor, Clifford Osawaru for trespassing into a parcel of land in Benin.

The court presided over by Justice Ada Ehigiamusoe, affirmed Alhaji Tanko Ileogben as the rightful owner of the land measuring 300 feet by 500 land, situated at plot 36-39 Block K, Evbuoriaria layout in Benin City in a suit Number B/463/14.

Delivering judgement on the case between the Claimant, Alhaji Tanko and pastor Clifford Osawaru (defendant) on Wednesday May 2, 2018, Justice, Justice Ehigiamusoe said the N10 million which was met for “general, special and exemplary damages over act of trespass and granted possession of the said land to the Claimant”.

The court also “granted a perpetual injunction restraining the defendant, his servants, Agents or privies from trespassing, constructing any structure there on or acting in any manner whatsoever inconsistent with the Claimant possessory title over the said parcel of land”.

In compliance with the judgement, the Claimant who was accompanied with policemen along with the court Bailiff have moved to execute a warrant of possession, writ of attachment to execute the judgement.

As at the time of filing this report, the Bailiff has concluded the process of mapping the parcel of land with red tape while surveyors were on ground to determine it’s boundaries.

Our Correspondent spotted a bulldozer at the site already clearing the entire land space of debris.

Counsel to the Claimant, Barrister Ohiwere Ileogben emphasized that his Client was all out to reclaim his property, following a high court verdict which resolved the case in his favour.

He however urged prospective developers to be wary of buying unverified properties.

Two surveyors who were in the line of duty at the site, Muhammed Tijani and Christian Uka Onu, explained that the pillar points of the parcel of land has been re-established in line with the court judgement.
